TERMS & CONDITIONS

These Website Terms & Conditions (“Terms”) govern access to and use of www.safashionweek.co.za and any SAFW-managed webpages, microsites or digital services that link to these Terms (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, you should not use the Site.

“SAFW”, “we”, “us” and “our” refer to South African Fashion Week and, where applicable, its operating entity, Runway Productions. SAFW is based in Johannesburg, South Africa.
The Site supports SAFW’s fashion-industry activities, including designer information, programmes, events, media content, competitions, partnerships, trade activities, accreditation, editorial material and links to related services.

You may use the Site for lawful personal, professional, editorial and informational purposes in accordance with these Terms and any additional terms that apply to a particular SAFW service or programme.
You may not use the Site in a way that is unlawful, fraudulent, misleading, abusive, defamatory, infringing, harmful to SAFW systems or users, or intended to gain unauthorised access to data, accounts, networks or content.

Unless stated otherwise, the Site and its content are owned by, licensed to, commissioned by or lawfully used by SAFW and are protected by copyright, trade mark and other intellectual-property laws. This includes text, designs, graphics, logos, marks, photographs, runway imagery, videos, audio, programmes, data, artwork, layouts and other materials.
You may view the Site and may download or print reasonable extracts for your own lawful, non-commercial reference. You may not reproduce, republish, sell, distribute, adapt, scrape, commercially exploit or create derivative commercial products from SAFW content without permission from the relevant rights holder.
Nothing on the Site grants a licence to use the SAFW name, logo, trade marks, partner marks, designer marks or other branding in a way that suggests endorsement, sponsorship, affiliation or approval without written permission.

Certain images, videos, press releases, media packs or other materials may be made available for bona fide editorial or media use. Any such use is subject to the usage conditions, credits, embargoes, territorial restrictions, licence terms or instructions supplied with the material.
Unless expressly permitted, press or runway assets may not be used for advertising, merchandising, resale, artificial-intelligence training datasets, commercial brand endorsements or any purpose that materially alters the context of the original SAFW or designer content.
Third-party content remains subject to the rights of the relevant photographer, videographer, designer, model, agency, sponsor, publisher or other rights holder.

When you submit an application, registration, biography, portfolio, image, video, comment, media request or other material to SAFW, you confirm that the information you provide is accurate to the best of your knowledge and that you are entitled to provide the material.
You retain ownership of intellectual property that you submit unless separate programme or contractual terms state otherwise. Where you intentionally submit material for publication, promotion, judging, accreditation or inclusion in an SAFW programme, you grant SAFW a non-exclusive licence to receive, store, review, reproduce and use that material to the extent reasonably necessary to administer that purpose and, where intended, to publish or promote the relevant SAFW activity.
Specific designer packages, competitions, media accreditation processes, programmes, partnerships and calls for entry may contain additional rules. Those specific rules apply in addition to these Terms and will prevail if there is a direct conflict on the same subject.

Submitting an entry or application does not guarantee selection, accreditation, participation, media access, a show slot, an award, commercial opportunity or any other outcome. SAFW may apply eligibility, judging, curation, capacity, payment, deadline, conduct and operational requirements contained in the relevant programme rules.
SAFW may reject incomplete, late, ineligible, misleading or non-compliant submissions where permitted by the applicable rules. Judging and selection processes are subject to the criteria and governance of the relevant programme.

Event dates, venues, line-ups, designers, speakers, programmes, availability and access arrangements may change for operational, production, safety, venue, sponsor or other reasonable reasons. SAFW will take reasonable steps to communicate material changes through appropriate channels.
Tickets or other transactions may be processed by independent third-party platforms such as ticketing, payment or registration providers. Where you transact with an independent provider, that provider’s terms, refund rules and privacy policy will also apply.
Where SAFW itself offers goods or services for electronic sale, the transaction page or related documentation may contain additional transaction-specific terms, pricing, cancellation information and statutory disclosures. Those terms form part of the applicable transaction.

If you subscribe to an SAFW newsletter or marketing communication, the use of your personal information is governed by the SAFW Privacy Policy and applicable law. You may unsubscribe from marketing communications using the mechanism provided in the communication.

Without limiting clause 2, you must not:
· attempt to bypass security controls, probe vulnerabilities or gain unauthorised access to the Site, accounts or data;
· introduce malware, malicious code, automated attacks or other harmful technology;
· use automated scraping, harvesting or extraction tools in a way that materially burdens the Site or infringes rights;
· impersonate SAFW, a designer, partner, sponsor, employee, media representative or another person;
· misuse personal information obtained through the Site;
· upload or transmit content that is unlawful, infringing, defamatory, discriminatory, threatening or intentionally deceptive;
· use SAFW content, data or marks to train or market a product or service in a way that implies SAFW authorisation where none exists.

SAFW aims to keep the Site useful and current but does not guarantee uninterrupted, error-free or continuously available access. SAFW may update, suspend, remove or change Site content, features or functionality for operational, security or other reasonable purposes.
SAFW may correct errors and update information without prior notice. Archived programmes, dates, statistics and historical material should be understood in their original context.

SAFW takes reasonable care in publishing information, but fashion-week programmes and live-event information can change quickly. Unless a statement is expressly identified as a binding offer or contractual commitment, Site content is provided for general information and should not be treated as professional, financial, legal or other specialist advice.
If a specific event notice, designer agreement, competition rule, accreditation term, ticketing term or written contract conflicts with general Site information, the specific applicable document will govern that matter.

The Site may contain links to or embedded content from independent third parties, including designers, sponsors, partners, social-media platforms, video platforms, ticketing providers, payment providers and media organisations. SAFW does not control independent third-party websites or services and is not responsible for their content, availability, security, terms or privacy practices.
A link, mention or embed does not by itself constitute an endorsement by SAFW.

Personal information collected through the Site is processed in accordance with the SAFW Privacy Policy. The Site may use cookies and similar technologies as described in that policy and in any cookie controls presented on the Site.

To the extent permitted by law, the Site and general Site content are provided on an “as is” and “as available” basis. SAFW does not warrant that every item of Site content will be complete, current, error-free or suitable for every user’s particular purpose.
Nothing in these Terms limits any warranty, right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or other applicable law.

To the maximum extent permitted by law, SAFW will not be liable for indirect, consequential or purely economic loss arising solely from use of, inability to use, or reliance on general Site content, including loss caused by third-party services outside SAFW’s reasonable control.
This clause does not exclude or limit liability that may not lawfully be excluded or limited, and does not override rights or remedies available to consumers under applicable South African law.

You are responsible for your own use of the Site and for material you submit. To the extent permitted by law, you may be responsible for loss suffered by SAFW or another person as a direct result of your unlawful use of the Site, infringement of third-party rights, or material breach of these Terms.

SAFW may restrict, suspend or terminate access to all or part of the Site where reasonably necessary to protect the Site, SAFW, users or third parties, to respond to unlawful activity or a serious breach of these Terms, or to comply with a legal obligation.

SAFW may update these Terms from time to time. The current version will be published on the Site with its effective date. Continued use of the Site after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.

These Terms are governed by the laws of the Republic of South Africa.
Any dispute relating to the Site may be brought before a South African court or other forum that has jurisdiction. Nothing in these Terms removes a consumer’s right, where applicable, to approach the National Consumer Commission, an ombud, the Information Regulator or another competent statutory body.

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
A failure by SAFW to enforce a provision immediately does not amount to a waiver of that provision or any other right.
These Terms do not replace a signed agreement, designer package, sponsorship agreement, competition rule, accreditation term or other specific SAFW contract. Those documents continue to govern their respective subject matter.
